BACKGROUND

[1] On November 10, 1997, Mr. Peter Watson, Director of Southern East Slopes and Prairie Regions (Director), Alberta Environmental Protection (Department), issued Approval 47294-00-00 to Yuan Yi (Canada) Co. Ltd. (Approval Holder) for the construction, operation and reclamation of a red meat processing plant in the City of Lethbridge in accordance with Division 2, of Part 2, of the Environmental Protection and Enhancement Act.(1)

[2] On December 9, 1997, the Environmental Appeal Board (the Board) received a Notice of Appeal from Mr. Barry Marquardson with respect to the Approval issued to Yuan Yi (Canada) Co. Ltd.

[3] Additional appeals were filed by Ms. Sylvia Campbell on behalf of Southern Alberta Environmental Group dated December 6, 1997, Mr. Irvin Duncan dated December 8, 1997, Mr. Jim Penton on behalf of Citizens for Environmental Responsibility and Public Disclosure dated December 9, 1997, Mr. Ronald Harrison, Mr. Mickey Moriyama, Mr. Edward J. Ryan, Ms. Gladys Ikle, Mr. James Burness and Mr. Bronic Kasperski dated December 11, 1997.

[4] By copy of a letter dated December 9, 1997, the Board requested the Department of Environmental Protection (Department) provide all related correspondence, documents and materials.

[5] The Board held a preliminary meeting on February 13, 1998, in Lethbridge and parties were given the opportunity to provide written submissions to the Board following that meeting. On March 20, 1998, the Board received a press release from the Department issued by Yuan Yi (Canada) Co. Ltd. informing that Yuan Yi, has determined that the project cannot proceed.

[6] The parties requested that the appeals be held in abeyance and the Board granted this request.

[7] On February 4, 1999 the Board received a letter from the Department advising that the Director cancelled the Approval issued to Yuan Yi (Canada) Co. Ltd.

[8] On March 12, 1999, the Board advised the parties that "[u]nless any party contacts us in writing to the contrary, the Board will close its file on Friday, March 19, 1999." Neither the Department or the approval holder responded.

DECISION

[9] Pursuant to Part 3 of the Environmental Protection and Enhancement Act, the Board hereby closes its files with respect to these appeals.
