BACKGROUND

[1] On April 13, 1999, the Director of the Northwest Boreal Region, Alberta Environmental Protection (Department), issued Amending Approval No. 10002-00-03 to AEC West Ltd. AEC West originally filed an application to amend Approval No. 10002-00-02 to increase the average one-hour SO2 concentration from 2900 ppm to 3500 ppm. Public notice, correspondence, and community consultation was provided detailing the above request. An amending approval (No. 10002-00-03) was issued increasing the average one-hour SO2 concentration to 3300 ppm, rather than the 3500 ppm that was formally applied for.

[2] On May 12, 1999, the Environmental Appeal Board (Board) received a Notice of Appeal from Ms. Shelly Glass on behalf of Mr. Alan Johnston of AEC West Ltd. The relief the appellant sought was to increase the average one-hour SO2 concentration from 2900 ppm to 3500 ppm, not to 3300 ppm, as issued.

[3] On May 13, 1999 the Board acknowledged receipt of the Notice of Appeal from Ms. Shelly Glass with respect to Amending Approval No. 10002-00-03 and requested a copy of all correspondence, documents, and materials relative to the file from the Department.

[4] On May 18, 1999 the Board received a letter from Ms. Shelly Glass stating, among other things:

"Please accept this letter as our formal withdrawal of Appeal No. EAB 99-129."

 

DECISION

[5] Pursuant to Section 87(7) of the Environmental Protection and Enhancement Act, and based on Ms. Shelly Glass' letter of May 18, 1999, the Board hereby discontinues its proceedings in Appeal No. 99-129 and will be closing its file.
